
On the Central Control Commission’s Decision On Kerala Expulsions
The Central Committee had held a two-day session in August 1998 to discuss the inner-Party organisational problems in Kerala. The Central Committee after discussion adopted a resolution on Kerala Party Affairs which was then reported and implemented. In that resolution, the CC approved the disciplinary action taken by the Kerala State Committee against the four Party members as per the Party constitutional requirements. These four members were V.B. Cherian, Appukuttan Vellikunnu, Suresh and Subhash. The main points of the Kerala resolution was incorporated in the political-organisational report submitted to the 16th Party Congress in October 1998 at Kolkata. The Political Organisational Report was endorsed by the Congress. Subsequently, the Central Control Commission constituted by the Congress took up for consideration the appeals made by the four expelled members which had been submitted before the Party Congress. The Central Control Commission decided to rescind the explusion of the four party members and to reinstate them in their earlier positions. The Polit Bureau requested the CCC to reconsider the decision. The CCC after reconsideration recommended that after restoring the membership of the four Party members, fresh notices of disciplinary action may be issued to them and proceeded with. There was a divergent stand taken by the CCC and the PB on the issue. This matter was discussed in the Central Committee in August 2000. The CC decided that this matter should be referred to the Party Congress which is the supreme body in the Party in view of the conflicting stand that emerged between the CCC and the PB. The specific case of expulsion of the four party members from Kerala was approved by the CC alongwith an overall discussion on the political organisational discussion on Kerala. The resolution on the Kerala situation adopted by the CC was comprehensive and covered the entire political organsiational situation in the Party. The Party Congress had endorsed this resolution in totality. The situation changed further since the Central Committee decision. All the four persons expelled have been openly campaigning and working against the Party after forming an anti-Party platform. There is therefore no question now of reinstating them in the Party. In such a situation, while the authority and integrity of the Central Control Commission has to be maintained this specific decision of the Central Control Commission should not be taken up for implementation. While these specific disciplinary actions are no more a subject for consideration, the question which arose about the role of the Central Control Commission as it is presently defined in the Constitution and its jurisdiction in the eventuality of conflicting views with the Central Committee needs to be taken up. The Party Congress therefore directs the new Central Committee to examine this issue in depth and take appropriate measures to resolve the matter.
